Terms of Use

Please read these Terms carefully before using Pour Toi. By creating an account or using any part of our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

These Terms constitute a binding legal agreement between you and Lienskill Limited ("Pour Toi", "we", "us", or "our"). They govern your access to and use of the Pour Toi mobile application, website, and related services (collectively, the "Services").

1. Eligibility

To use Pour Toi, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding contract in your jurisdiction.
• Create and maintain only one account in your real name.
• Not have been previously permanently banned from our Services.

By registering, you confirm that you meet these requirements. We reserve the right to verify eligibility at any time and to remove any account that does not comply.

2. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@pourtoi.love if you suspect unauthorised access. We are not liable for any loss resulting from your failure to protect your account.

You may not share your account, transfer it to another person, or use another person's account without their permission and ours.

3. User Conduct

By using our Services, you agree to comply with our Community Guidelines, which are incorporated into these Terms by reference. You must not use our Services to:

• Post false, misleading, or fraudulent information about yourself or others.
• Harass, threaten, intimidate, or harm other members.
• Solicit money, gifts, or financial benefit from other members.
• Upload, share, or transmit illegal content of any kind.
• Circumvent or interfere with our safety systems or technical infrastructure.
• Scrape, harvest, or systematically access member data.
• Use automated bots or scripts to interact with the platform.
• Engage in or facilitate commercial sex work, human trafficking, or coercive arrangements.
• Contact or solicit individuals you believe or suspect to be under 18.

4. What Pour Toi Is — and Is Not

Pour Toi is a platform designed to help adults connect with others who share serious relationship intentions. We provide tools and features to support that goal. However:

• Pour Toi is not a marriage broker or matchmaking agency. We do not guarantee that you will find a partner, enter a relationship, or get married. Our Services are a tool; your outcomes depend on your own choices and circumstances.
• Pour Toi is not a therapy or counselling service. The AI Coach and other features are not substitutes for professional mental health, relationship, or legal advice.
• Pour Toi is not an investigation or background check agency. We cannot independently verify the identity, history, intentions, or truthfulness of members beyond our stated verification steps.
• Pour Toi is not an emergency service. If you are in immediate danger, contact your local emergency services (such as 999, 911, or 112) directly. We cannot provide real-time emergency response.
• Online dating carries real risks. Meeting people online, and eventually in person, involves risks that exist beyond any platform's control. You are responsible for taking appropriate precautions. We strongly recommend reading our Dating Safety Tips.

5. AI Features and Automated Systems

5.1 AI Coach

The AI Coach is an AI-powered conversational assistant that provides guidance on dating, profile presentation, and relationship topics. Conversations with the AI Coach are processed using third-party AI services and stored on our servers. AI Coach responses are generated automatically and may be incomplete, inaccurate, or unsuitable for your specific situation. The AI Coach is not a therapist, relationship counsellor, or professional advisor. Do not rely on it for mental health support, legal advice, or safety decisions.

5.2 AI-Generated and AI-Assisted Content

Certain features on Pour Toi can produce content that is fully or partially generated by AI, including suggested introduction messages and profile writing assistance. When AI is used to generate content on your behalf, this is disclosed at the point of use. You remain solely responsible for any content you choose to send or publish, regardless of whether it was AI-generated or AI-assisted. AI outputs are suggestions only and may contain errors, biases, or inappropriate language.

5.3 AI-Mediated Introductions

Pour Toi may use AI to facilitate introductions between members, including composing initial connection messages based on profile data. Where this occurs, it will be disclosed to the recipient. Members may opt out of AI-mediated introductions at any time through their account settings.

5.4 Behavioural Risk Assessment

We use automated systems to detect potentially harmful behaviour and protect members. These systems may flag accounts or restrict activity automatically. Significant account actions resulting from automated flags are subject to human review. You may appeal any restriction — see Section 11.

6. Photo Verification and Identity

Pour Toi requires profile photo verification for all members. Our automated systems, using third-party image analysis, check that your photo shows a real, single human face and is not AI-generated. This verification process:

• Confirms that a real person is behind the account.
• Does not verify that the person in the photo matches any other claimed attribute.
• Does not guarantee that a member's stated age, name, location, or intentions are truthful.
• Is not a background check and does not reveal criminal history, relationship status, or legal standing.

You must not submit another person's photo or an AI-generated image as your own. Doing so is a serious violation of these Terms and may result in permanent removal.

7. Subscriptions, Trials, Billing, and Refunds

Pour Toi offers a free tier and optional paid subscription plans. Subscriptions are billed through PayPal. The full details of our subscription plans, free trial terms, cancellation process, and refund policy are set out in our Billing & Subscription Policy, which forms part of these Terms.

Key points:

• Free trials automatically convert to paid subscriptions unless cancelled before the trial ends.
• Subscription fees are generally non-refundable except as required by law.
• Subscription benefits are tied to your account and are not transferable.
• If your account is terminated for a Terms violation, no refund will be issued for any remaining subscription period.

8. Content You Post

You retain ownership of the content you post on Pour Toi (photos, bio, messages). By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and process that content for the purpose of providing the Services to you and other members. This licence ends when you delete the content or your account, subject to safety and legal retention requirements.

You are solely responsible for the content you post. You must not post content that violates third-party rights, applicable law, or our Community Guidelines.

9. Intellectual Property

All rights in the Pour Toi platform, brand, design, and technology are owned by Lienskill Limited or our licensors. You may not copy, reproduce, modify, or create derivative works from our platform or content without our written permission. Your licence to use the Services is personal, non-transferable, and non-exclusive.

10. Termination and Suspension

We may suspend or terminate your account at any time, with or without prior notice, if we believe you have violated these Terms or our Community Guidelines, if your account poses a risk to other members, or if required by law. You may close your account at any time through your account settings.

Upon termination, your right to use the Services ends immediately. Sections 12, 13, 14, and 15 of these Terms will continue to apply after termination.

11. Appeals

If your account has been suspended or restricted and you believe this was in error, you may submit an appeal to support@pourtoi.love. We will review appeals and respond within a reasonable time. Appeals do not guarantee reinstatement. We will not reverse decisions involving confirmed child safety violations or serious threats of harm.

12. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Services will be uninterrupted, error-free, or fully secure at all times.
• Any member's identity, profile information, or stated intentions are accurate.
• The AI Coach or other AI-generated content is accurate, complete, or appropriate for your needs.
• Our safety systems will prevent all harm or detect all violating behaviour.
• Use of our Services will result in any particular relationship outcome.

13. Limitation of Liability

To the fullest extent permitted by law, Lienskill Limited and its directors, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, including but not limited to: loss of data, personal injury, emotional distress, financial loss caused by another member's conduct, or harm resulting from reliance on AI-generated content.

Our total cumulative liability for any claim arising under these Terms will not exceed the greater of (a) the total amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not permit the exclusion or limitation of certain liabilities. In those jurisdictions, our liability is limited to the minimum extent permitted by applicable law.

14. Indemnification

You agree to indemnify and hold harmless Lienskill Limited and its affiliates, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

15. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer protection laws in your country require otherwise.

If you have a complaint about our Services, we encourage you to contact us first at support@pourtoi.love so we can try to resolve it before pursuing formal proceedings.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice before they take effect. Your continued use of the Services after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services and may close your account.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
